Terms and Conditions for Woodchuck Lawn & Tree LLC

Welcome to Woodchuck Lawn & Tree LLC. These Terms and Conditions govern your use of our website located at https://woodchucktreellc.com/ and the tree care, removal, plant health care, and related services we provide.
By accessing the Site or engaging our Services, you agree to be bound by these Terms.
1. General Information
Woodchuck Lawn & Tree LLC is a tree service company based in Bumpass, Virginia, serving Louisa County, Goochland County, Hanover County, and surrounding communities. We are fully licensed, insured, and led by an ISA and TRAQ-certified arborist.
2. Estimates and Proposals
All estimates provided by Woodchuck Lawn & Tree LLC are free of charge and valid for thirty (30 ) days from the date of issue unless otherwise stated in writing. Estimates are based on a visual inspection of the property and the specific scope of work discussed. If the scope of work changes, or if unforeseen conditions arise once work begins (such as hidden concrete, metal, or extensive decay inside a tree), we reserve the right to adjust the final price. Any changes will be communicated to you and agreed upon before proceeding.
3. Scheduling and Delays
We strive to complete all scheduled work promptly. However, tree care is highly dependent on weather conditions and safety factors. We reserve the right to reschedule work due to severe weather, high winds, equipment failure, or other unforeseen circumstances beyond our control. We will communicate any delays as soon as possible and work with you to reschedule at the earliest convenience.
4. Property Access and Preparation
By hiring Woodchuck Lawn & Tree LLC, you grant our crew and equipment full access to your property to perform the agreed-upon Services. It is your responsibility to ensure the work area is free of vehicles, outdoor furniture, toys, pet waste, and other obstacles before our arrival. While we use yard protection mats and take extreme care to protect your property, the use of heavy equipment is often necessary. We are not responsible for minor, unavoidable wear to lawns or driveways caused by standard equipment use.
5. Underground Utilities and Structures
You are responsible for identifying and marking all private underground utilities, including irrigation systems, invisible fences, landscape lighting, septic systems, and private power lines, prior to our arrival. Woodchuck Lawn & Tree LLC will contact Miss Utility (Virginia 811) to mark public utilities when necessary. We are not liable for damage to unmarked or improperly marked private underground structures.
6. Stump Grinding
Unless specifically stated in your written estimate, tree removal does not automatically include stump grinding. If stump grinding is contracted, the stump will generally be ground to a depth of 4 to 6 inches below the surrounding soil grade. The resulting wood chips and soil mixture will be left neatly mounded in the hole unless debris removal is explicitly included in your contract.
7. Wood and Debris Removal
Our standard services include the cleanup and removal of all major debris, branches, and logs, leaving your property clean. If you request that we leave wood for firewood, we will cut it to manageable lengths and leave it on site. Any specific requests regarding the size or placement of wood and mulch must be discussed with your estimator and included in your contract.
8. Payment Terms
Payment is due in full upon completion of the agreed-upon Services unless alternative arrangements have been made in writing prior to the start of the job. We accept cash, checks, and major credit cards. Late payments may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance, plus any costs associated with collection, including reasonable attorney’s fees.
9. Cancellation Policy
If you need to cancel or reschedule your service, please provide at least 48 hours’ notice. Cancellations made with less than 48 hours’ notice may be subject to a cancellation fee to cover scheduling losses and administrative costs.
10. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Woodchuck Lawn & Tree LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or use any content from the Site without our express written permission.
11. Limitation of Liability
To the fullest extent permitted by law, Woodchuck Lawn & Tree LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or our Services. Our total liability for any claim shall not exceed the total amount paid by you for the specific Services giving rise to the claim.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in or serving Louisa County, Virginia.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site or our Services after the posting of any changes constitutes your acceptance of the revised Terms.
